Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the ScreenFox website and mobile application (the "Service") operated by Deyi Rao ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Definitions

  • "Service" refers to the ScreenFox website, mobile application, and related services
  • "User" or "You" means any individual who accesses or uses the Service
  • "Content" means any information, text, graphics, or other materials uploaded, downloaded, or appearing on the Service
  • "Digital Fox" or "Digital Companion" refers to the virtual fox companion feature within the ScreenFox app that reflects your digital wellbeing
  • "Health Points" or "HP" refers to the virtual health system of your Digital Fox that decreases with usage of selected apps

2. Use of the Service

2.1 Eligibility

To use the Service, you must:

  • Be at least 16 years old, or have parental consent if under 16
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Service under applicable laws

2.2 No Account Required

ScreenFox does not require user accounts, passwords, or registration to use the app. The app functions entirely on your local device without cloud accounts or authentication.

You are responsible for maintaining the security of your device and any device backups that may contain your ScreenFox data.

2.3 Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation
  • To transmit any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable
  • To impersonate or attempt to impersonate ScreenFox, a ScreenFox employee, another user, or any other person
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
  • To attempt to interfere with the proper working of the Service

3. How ScreenFox Works

ScreenFox is a digital wellbeing app that helps you build healthier relationships with social media and mobile apps through mindful usage, gentle restrictions, and gamification.

3.1 The Digital Fox Companion

At the center of ScreenFox is a virtual fox companion that reflects your digital wellbeing. The fox has a health point (HP) system:

  • Plenty of HP: the fox is happy and smiling
  • Some HP: the fox appears neutral
  • Almost no HP: the fox becomes sad and starts crying
  • Zero HP: access to restricted apps is blocked for the rest of the day

3.2 Daily Limits & Reset System

You define which apps to manage and set daily usage limits. HP decreases with app usage and drops to zero when limits are exceeded. At the end of each day, usage limits reset and HP is restored to 100.

3.3 Focus Sessions

Focus sessions help you regain control and restore balance. Restricted apps are blocked during focus time. Completing a session restores HP, allowing additional app usage time.

3.4 User Control

All restrictions are fully user-defined and can be changed at any time. ScreenFox is designed to support awareness and self-regulation, not enforce control.

4. Screen Time Permissions and Data Storage

ScreenFox requires access to your device's screen time data to function properly. By using the Service, you consent to:

  • Granting necessary permissions to access screen time data and app usage information
  • Processing this data locally on your device for gamification and habit tracking
  • Storing this data locally on your device only (not on our servers)

We do not collect, transmit, or have access to your screen time data, HP status, usage history, or any other app content. This data remains on your device only. For more details, please see our Privacy Policy.

5. Intellectual Property

5.1 Ownership

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Deyi Rao and its licensors. The Service is protected by copyright, trademark, and other laws of Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Deyi Rao.

5.2 User Content

You retain any and all rights to any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with providing the Service.

6. Subscriptions and Payments

6.1 Subscription Terms

Some parts of the Service may be billed on a subscription basis. All payments are processed through the Apple App Store. You will be billed in advance on a recurring and periodic basis (monthly or annually, depending on your subscription plan). Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms.

6.2 Price Changes

We reserve the right to adjust pricing for our Service or any components thereof at any time. Any price changes will take effect at the beginning of the next billing cycle following the change.

6.3 Cancellation

You may cancel your subscription at any time through your Apple ID settings. Your cancellation will take effect at the end of the current billing period. You will not receive a refund for the current billing period. We do not have access to manage your subscription directly.

6.4 Subscription Tracking

We use RevenueCat to track subscription status and in-app purchases for app functionality purposes. RevenueCat receives anonymous transaction data but does not have access to your app usage data, screen time, or personal content.

7. Termination

We may discontinue the Service at any time. If you breach these Terms, we may restrict your access to the Service.

You may stop using the Service at any time by uninstalling the app. Since ScreenFox does not use accounts, there is no account deletion process. Your local data can be removed by uninstalling the app or clearing app data through your device settings.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Deyi Rao, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

9. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Deyi Rao does not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Dispute Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
